From the limited amount of research that we have done, it appears that artists become members of two main groups: ASCAP (American society of Composers, Authors, and Publishers) and BMI (Broadcast Music Incorporated). These groups collect royalties from mass media companies on behalf of the artists, composers, what have you, and distribute the royalties received to their respective respresentees.

The new legislation is not necessarily closing a loophole, but providing double compensation for the artists whose CD's are given to the radio stations (some stations are even given media to play without the expectation of compensation).
